Question: Should I study abroad after 12th standard or do my graduation in India? – Nikhil Soni, Ahmedabad Answer : One should go abroad after completing graduation and if one has performed very well in it i.e. first class then go abroad for masters degree. Question: I am 25 years old. I am currently living in Canada on a student visa. Our family's F-4 May 2006 file has been approved on 7-8-2006. My uncle checked with NVC and got a reply that I am not eligible for green card. Our file is in process. So what to do? Is there any other way to process?- Smit Patel, Canada Answer : If you are not eligible due to aging out then your parents can file petition for you under F-2B category after getting green card. Just double check the date you state that your F-4 petition was approved within three months, as such petitions are usually not approved that quickly. The approval letter is headed I-797 notice of action, in which it is clearly stated that Approval Notice and it is written that Your Petition is Approved. If this letter comes after few years then appeal can be done. Question: My husband has filed a petition for his sister's family, which is now open. My husband has Parkinson's disease. So they have been staying in India for 6 years. So when should he go to America? We don't have co-sponsors and not enough funds. So what to do? – Jacinta Sheth, Ahmedabad Answer : Your husband can go to America before his sister's family has an interview. But if it is not possible to travel, then the interview can be presented by showing medical certificate etc. documents. A co-sponsor is required for your file. Question: My son has applied for a new passport, but in his SSC marksheet the name is Kevan Jayeshbhai Buch, while in Aadhaar card it is Kevan Jayesh Buch. So what to do?- Jayesh Buch, Rajkot Answer : You should get your son's passport as per the correct name in his birth certificate. School record or Aadhaar card is not important for going abroad. Only the birth certificate is accepted as a government record. Passport should always be done on the basis of birth certificate. Question: I am 72 years old and my wife is 69 years old. Our son lives in Berlin, Germany. We have been to Germany and back many times. Our desire is to visit America once. So if we apply online for US visitor visa, do we have to submit proof of income, proof of bank balance etc. along with the passport or should we carry the documents during the interview?- Kishore Gupte, Valsad Answer: There is no need to submit documents other than the passport along with the visitor visa form. You can carry it with you during the interview. You can show your income, property etc. in the form. No documents are required while applying for US Visitor Visa. Question: If my son applies for a visitor visa and gets a US visa, can he work in the US? Can visitor visa be replaced? – Dineshbhai Thakor, Borsad Answer : No, visitor visa is non immigrant visa, which is temporary for 6 months at the airport there. If your son works and his information is found, he can be deported back. It is not necessary to take such a risk. Question: My grand son was born in America. He is now seven years old and lives with his parents. Could it be useful to get his parents a green card? Her parents are in the US on H-1B. – Haresh Shah, Ahmedabad Answer : Your grandson can file a petition for his parents after he turns 21, only if he has got citizenship. Rather, consult an expert immigration attorney there to find out whether his name can be entered in the H-1B visa at present. Generally, a child who is born in America is called a born citizen. That means citizen by birth is considered legal. Question: My sister's birth certificate has Minaben and all other documents have a different name. So what to do?- Doctor Nityam Ojha Answer : If your sister's real name is as per the birth certificate then it should be in the passport as per the same name, so that there is no problem if she petitions for you as a citizen.
