UCC draft ready in Uttarakhand: Report to be submitted to CM Dhami soon; Can be applied from November 9

CM Dhami recently announced that the government wants to implement the UCC on Uttarakhand's foundation day on November 9.

A final report has been prepared on the implementation of Uniform Civil Code (UCC) in Uttarakhand. The UCC committee constituted by the state government will soon submit this report to Chief Minister Pushkar Singh Dhami.

The report is a draft of recommendations prepared to implement the UCC in Uttarakhand, including provisions for uniform application of personal laws such as marriage, divorce, inheritance and adoption.

CM Dhami recently announced that the government intends to implement the UCC on Uttarakhand's foundation day on November 9. Uttarakhand will be the first state in the country to do so.

Surekha Dangwal, Abhinav Kumar, Amit Sinha and Manu Gaur have been included as members along with Chairman Shatrughan Singh.

The President gave the nod on March 13 On 13 March, the UCC Bill received the President's assent. Dhami then thanked the President. He said that the government has fulfilled its promise to the public during the 2022 assembly elections. He said that implementation of Uniform Civil Code will give equal rights to all citizens and will also curb atrocities on women.

The UCC Bill was passed in the Assembly on February 7 The Uniform Civil Code Bill was passed by voice vote in the Uttarakhand Legislative Assembly on 7 February. CM Pushkar Dhami introduced this bill in the assembly on February 6.

As soon as this bill becomes law, registration will become mandatory for people living in live-in relationships in Uttarakhand. Failure to do so may result in imprisonment of up to 6 months. Apart from this, second marriage while husband or wife is alive will also be considered illegal.

After the bill was passed, Chief Minister Pushkar Singh Dhami said – Today is a very special day for Uttarakhand. I would also like to thank Prime Minister Narendra Modi for his inspiration and guidance that gave us the opportunity to pass this bill in the Uttarakhand Assembly.

Different people were saying different things about the Uniform Civil Code Act, but everything has become clear in the debate in the Legislative Assembly. We have not brought this law against anyone. This law is also in the interest of children and motherhood.

What will change with the Uniform Civil Code, understand in 5 points…

  1. Equal Property Rights: Both son and daughter will get equal rights in the property. It doesn't matter which category they belong to.
  2. Property after death: If a person dies, the Uniform Civil Code gives the right to divide that person's property equally between the spouse and children. Apart from this, the parents of that person will also have equal rights in the property. In the earlier law, this right was available only to the mother of the deceased.
  3. Divorce will be granted only on similar grounds: Divorce shall be granted to husband and wife only when both the grounds and reasons are the same. Divorce will not be granted if only one party gives reasons.
  4. Live-in registration required: If couples living in Uttarakhand are living in a live-in relationship, they have to register. Although this will be like self-declaration, Scheduled Tribes will be exempted from this rule.
  5. Responsibility of the child: If the child is born out of a live-in relationship, it will be the responsibility of the live-in couple. Both have to give their own name to that child. This will give identity to every child of the state.

The 800-page draft, 400 sections, received 2.5 lakh suggestions The report prepared by the expert committee of UCC in Uttarakhand has about 400 sections. And in this draft report of around 800 pages, 2.31 lakh suggestions from across the state, online and offline, have been included. The committee has directly contacted 20 thousand people. All religious leaders, organizations, political parties and legislators have been consulted during this period. whose suggestions were incorporated in the draft by the committee.

The tribals of the state were kept outside the law This Act will not apply to tribals of Uttarakhand. There are five types of tribes in the state which include Tharu, Boxa, Raji, Bhotia and Jaunsari community. After the 1962 war with China they were notified in 1967 for inclusion in the tribal community under Article 342 of the Constitution. Recently Assam CM Himanta Biswa Sarma has also said that he will exempt the tribals and tribals in his state from this law.
