Congress General Secretary Jairam Ramesh has made a big claim amid the ongoing controversy over the claim of demolishing temples and building Jama Masjid in Sambhal and Dargah in Ajmer. He wrote on X that former CJI DY Chandrachud's remarks on May 20, 2022 paved the way for such petitions.
Former CJI Chandrachud commented on The Place of Worship Act, 1991 during the hearing of the Gnanavapi Masjid case. He said that the Act does not impose any restrictions on determining the religious character of a place of worship.
In fact, this law prohibits changing the nature of any religious place. Accordingly, the site will be preserved in the same form as it was on August 15, 1947. Even if it is proved that it was built by demolishing a place of worship of another religion, its form cannot be changed.
