Mahayuti has won 230 out of 288 seats in the state. While MVA has got 46 seats.
The new Chief Minister in Maharashtra will be from the BJP. Chief Minister Eknath Shinde will submit his resignation to the Governor on Tuesday. He will remain the acting CM till the new CM takes charge. This consensus formula has been decided after a long discussion between Union Home Minister Amit Shah, Devendra Fadnavis, Eknath Shinde and Ajit Pawar in New Delhi on Monday night.
According to sources, BJP will hand over the responsibility of Chief Minister to Devendra Fadnavis. One each from Shiv Sena (Shinde group) and NCP (Ajit group) will be deputy CM. After the assembly election results, there was a tug-of-war between the BJP and Shiv Sena, two of the three major coalition parties, over the Chief Minister's post.
According to sources, the name of Fadnavis can be announced by Tuesday evening after the consensus on the chief minister is reached in the grand alliance. Also, after resigning from the post of CM, Eknath himself will not take the post of Deputy CM. He will forward the name of the MLA from the party itself. A committee of the three parties may be formed, headed by Eknath Shinde, to decide the government's agenda. The date of swearing in of the new CM has not been fixed. The tenure of the Assembly is till November 26.
On the other hand, in a meeting held at Uddhav Thackeray's residence Matoshree on Monday, Aditya Thackeray was elected as the leader of the joint legislative party i.e. joint leader of both houses (Assembly and Legislative Council). Bhaskar Jadhav was elected as the leader of the Shiv Sena (UBT) Legislature in the Assembly and Sunil Prabhu was elected as the Chief Whip.

MVA can file a joint suit against the Leader of the Opposition
In the assembly elections, none of the opposition parties got the required number of seats for the Leader of the Opposition (LoP) in the House. As per the rules, the post is given to the opposition party that wins at least 10% of the assembly seats.
If some parties have secured more seats than this, the position is given to the opposition party which has secured the highest number of seats. Not so this time, so MVA can claim the joint LoP position. In this regard, a letter will be written to the Governor to argue for a pre-poll alliance.

Raj Thackeray's party may lose credibility
Raj Thackeray's son Amit Thackeray contested from Mahim seat. He stood third. Mahesh Sawant of Shiv Sena (UBT) has won the seat.
Raj Thackeray's party Maharashtra Navnirman Sena (MNS) could not win a single seat in this election. The vote share of the party is also only 1.55%. Raj Thackeray's party may be de-recognized due to these results. The Election Commission can take away his symbol.
According to Election Commission rules, if the party has one MLA and 8% of the votes, the recognition remains. If two MLAs get 6% votes or three MLAs get 3% votes, it remains valid.
