2 accused in IIT-BHU student gang-rape acquitted: Bail from HC; welcome home garlands; Police said – all three are professional criminals

Two accused in gang rape of B.Tech student at IIT-BHU, Varanasi acquitted after 7 months. The Allahabad High Court has granted conditional bail to the accused Kunal Pandey and Anand alias Abhishek Chauhan. The court did not accept the bail of the third accused Samab Patel. His bail application will be heard on September 16. Kunal was released on 24th August while Anand was released on 29th August. According to neighbours, when Anand reached his home in Nagwa Colony on August 29, he was welcomed. Kunal and Anand's house is next door. All three accused of gang-rape were associated with BJP IT cell. He was in touch with big leaders including government ministers and MLAs. In this high-profile case, the Varanasi police filed a charge sheet of gangrape on January 17. The police registered a case against the three accused under the Gangster Act. After the gangster's case was registered, his bail application was continuously rejected. Three accused Anand, Kunal and Samal were arrested on 30 December 2023, 60 days after the incident, the police declared the trio professional criminals in the court. All the three accused were lodged in the district jail from 31 December 2023. He was kept in the barracks for accused involved in heinous crimes. The police chargesheet was based on the route chart, CCTV footage and mobile location of the three accused. Along with this, statements of the victim student, her friend and a guard have also been used as basis against the accused. The WhatsApp chat was also produced in the court and the seized bullets were also mentioned. The police told the court that the three are professional criminals and should not be allowed in public. Accused Anand filed a bail application on 11 November 2023, which was heard several times. When Anand cited several reasons, including his family's illness, the court granted bail on July 2, but imposed several conditions. The second accused, Kunal, also applied for bail in the High Court on July 2, 2024. On July 4, the court also accepted his bail. ADGC Manoj Gupta said that the trial of the three accused in the IIT-BHU gang rape is going on in the Varanasi Fast Track Court (POCSO). In July, the three accused applied for bail in the court. The bail applications of the three accused, Krunal, Anand alias Abhishek and Samal, were rejected on the opposition of the prosecution. This is not the first time but the court rejected the application twice before. The case against the accused and the charge sheet of the police was strong. After the plea was rejected, all approached the High Court, from where two were granted bail. On August 22, the rape victim recorded her statement in the court. The prosecution lawyer said that the court has expedited the hearing of the IIT-BHU gangrape case. In this case, the rape victim was first summoned by the court on August 22, after which the victim was produced in the court under police protection. The victim presented the BHU incident before the court. He stated that the three accused brutalized, threatened and then fled. The victim said that she was feeling pressured in many ways after the incident. I'm afraid to go out, so I stay in hostels most of the time. So far 2 charge sheets have been filed against the accused Police have so far filed two charge sheets against the accused. The first charge sheet was presented in the court on January 17, which included Section 376 (D) against the accused, among others. While prosecuting the case, the police charged the three accused as gangsters, with the charge sheet filed the following week itself. Police have identified Anand Chauhan alias Abhishek as the leader of the gang. While Kunal and Samal are said to be members of his gang. In this the police registered a case against Anand alias Abhishek and his family on 29 June 2022 at Bhelupur police station on molestation and other charges. It took 60 days to catch, the accused took shelter in Madhya Pradesh After committing the crime, the three accused went to campaign for the Madhya Pradesh assembly elections and stayed there for about 55 days. The police started investigating. As soon as the trio reached Varanasi, the police became active and managed to nab them after 60 days. Varanasi police examined a total of 225 CCTV footages from the campus and outside the campus. A total of 6 teams including Special Task Force (STF), Crime Branch and Surveillance were deployed in the search. What happened on the night of the incident? I met my friend near Gandhi Smriti Square in the campus. As we both were going together, a bullet came from behind about 300 meters from the temple on the road. 3 boys were riding on it. Those people stopped me and my friend by parking the bike. After this they separated us. They clamped my mouth and took me to a corner. There he first kissed me and then forced me to remove my clothes. Made my video and took photos. When I cried for help, he threatened to kill me. Kept me under their control for about 10-15 minutes and then released. As I ran towards my hostel, I heard the sound of a bike from behind. With fear I entered the house of a professor. Stayed there for 20 minutes and called the professor. The professor dropped me off at the gate. After that, Rahul Rathore of Parliament's Security Committee took me to the IIT-BHU patrolling guard. From where I could reach my hostel safely. Among the three accused, one was fat, the second was thin and the third was of medium height.
