Late actor Sushant Singh Rajput's former house helper Samuel Miranda has got a major relief from the Supreme Court. The court has upheld the decision of the Bombay High Court quashing the April 10 look out circular. And has also dismissed the Centre's appeal, challenging its order quashing the look-out circular issued against Sushant Singh Rajput's former house helper.
Dismissing the petition, the court said that no party was present during the hearing of the case. Also, we do not see any solid reason in the petition, the appeal is maintainable.
The High Court said that the look out circular was issued only on the basis of the FIR. There was no concern that the applicant could evade arrest or avoid attending the trial.
The High Court said that the look out circular was issued only on the basis of the FIR. It does not show that the applicant will try to avoid arrest or avoid attending the trial. Apart from this, the CBI did not present any fresh application before the court for continuation or renewal of LOC despite the expiry of one year period.
In 2024, Miranda sought the High Court to quash the LOC issued against him by the CBI in 2020. He said that the police has not given any report yet and this LOC is pending for three and a half years. Miranda also said this was affecting his right to travel abroad, a violation of his fundamental rights.
