Question: When my daughter files a green card petition for us as an American citizen i.e. parents and her brother, even if my son is 25 years old, according to the information I have received, a person up to 28 years of age will get a green card because he is unmarried?- Sudhir Patel, Gandhinagar Answer: No, it is not correct, because the petition of parents falls under a different category i.e. IR category. There is no rule as you state. You have to file two separate petitions. Question: My daughter has been to America twice after getting a 10-year visa. He has second marriage. I am his 17 year old granddaughter. I live alone with them. My mom also got second marriage. Due to which my surname has changed from Shah to another surname. My Nani has two daughters and one son. Now my little one goes to America if I want to go with them, can I get visitor visa?- A reader, Ahmedabad Answer: Can't say whether you will get visitor visa or not, because visa officer got doubt from your age and your facts. can Still try to apply and prepare fully for it. Question: I want to go to Poland for Masters degree, for which I take a personal loan and it is pending repayment, will my visa be affected? Can Indian authorities detain me at the airport if I get a student visa?- Kushal Sharma, Ahmedabad Answer : No, can't detain me at the airport, because taking a loan is not a crime. Hundreds of students take loans to study abroad. Your visa interview may ask who will pay the loan installments. So rather than taking a personal loan, it is better if your father or someone else takes a loan and pays your fees and installments. Question: My daughter's name was in the interview in our F-4 file. But his visa was rejected as he was 26 years old. We also did the aging out process. My elder son is a citizen of Canada so if we go to America my daughter will have to stay in India alone. So what should we do in this case? – A reader response: If the name came up in the interview, sending a copy of the appeal you made may provide further guidance. Apart from that, if your daughter remains unmarried after you get a green card, you can file a petition for her green card or try for a student visa. Question: My brother has been living in New Jersey for 17 years and is a US citizen. However petition cannot be filed for us as we don't have documents and my daughter is 18 years old. Can he go on a student visa? – Minal Patel, Ahmedabad Answer: If you have passport, birth certificate, marriage certificate, address proof etc. documents then you can file the petition. You can try for student visa or fill the form yourself for family visitor visa and send it to me for checking before applying. Question: I have come to India this year after staying in America for three months on a tourist visa. I got a 6 month visa at the airport there. Now I can travel again from India to USA after three months to meet my family?- Jimit Prajapati, Ahmedabad Answer : No, going twice or once in a year will ask many questions at US airport and CBP. The officer i.e. the Customs and Border Protection Officer may suspect that you are coming to America often to earn dollars by doing illegal jobs. A visitor can usually complete a tour of America in just a few months, so frequent visits can make your non-immigrant tourist seem unintentional. Question: I am an American citizen. I have filed a petition on 20-7-2010 in F-3 category for my married son and his family which has been approved in 2014. Another table from the October 2024 Visa Bulletin shows the F-3 category July 1, 2011. But till now I have not received any letter or email. I have not received a reply to my email either, as the department works electronically. What to do now?- Vijay Shah, America Answer : Generally the first table of visa bulletin i.e. table-1 should be seen. That is, complete information can be obtained by looking at Table-A Final Action Dates. Apart from this, information can be obtained on the website listed in Table-B. More information can be provided only after you receive the welcome letter. (The author is an immigration expert advocate and licensed legal consultant in the US.)
